Agreement Reached In Corker Greenway Lawsuit, No Details Given

An attorney said an agreement has been reached in a lawsuit brought against U.S. Senate candidate Bob Corker relating to a greenway easement at Eastgate.

However, no details were revealed.

The pact allows Mr. Corker to avoid a 3-hour deposition Oct. 20. Attorneys had asked for a delay, but Chancellor Howell Peoples had ruled the deposition must be taken at that time.

Attorney Roger Dickson, who represents the former Chattanooga mayor, said Friday afternoon, "The Tennessee Environmental Council, Inc., Coalition for Responsible Progress and Sandy Kurtz and Bright Par 3 Associates, L.P., Luken Holdings f/k/a Corker Group, Inc., Osborne Building Corporation and DBS Corporation announce that they have reached an agreement in principle to resolve their differences in the lawsuit entitled Tennessee Environmental Council, Inc., Coalition for Responsible Progress and Sandy Kurtz v. Bright Par 3 Associates, L.P.; Corker Group, Inc.; Osborne Building Corporation; DBS Corporation; Wal-Mart Real Estate Business Trust and The City of Chattanooga, No. 03-0775, in the Chancery Court of Hamilton County, Tennessee, Part 2.

"The parties are currently working on additional documentation relating to the dismissal of the lawsuit."

Sandy Kurtz, one of the plaintiffs in the lawsuit, was quoted as saying, ?This resolution is good for the environment and the citizens of Chattanooga.?
